Revelant Issues of the Labor Legal Responsibility of the Head of the Organization

The issues of the labor legal responsibility of the head of the organization are rather complicated and controversial. Responsibility for the norms of the Russian legislation is designed to ensure the rule of law in the sphere of employing wage labor, to stimulate the subjects of labor relations to the proper performance of the duties assigned to them, and consists in the unfavorable consequences for the subjects of the relevant relations in the event of non-fulfillment or improper performance of legal duties. In this article, current issues of attracting to labor legal responsibility of a special subject of labor relations — the head of the organization, are highlighted along with the legislative, law enforcement issues related to his dual status. The head of the organization is given many rights and a large number of responsibilities. In addition, he is an employee of the organization. Consequently, the legal status of the head of the organization has a number of features. Based on the analysis of the inherent distinctive features of the work function of the head of the organization, as well as the norms of the current Russian legislation and judicial practice, the authors conclude that there is a conflict in the legislation, and comes up with the proposals for their elimination.
